M2. Discussion: Who Owns It, For How Long, and Who Gets to Use It?

Copyright law determines who owns a creative work, how long that protection lasts, and how those rights can be shared, transferred, or licensed. Ownership generally belongs to the creator unless the work qualifies as a work made for hire, is jointly authored, or the creator transfers certain rights through an agreement.

Consider how these rules affect creators, employers, collaborators, and the public. In your response, address the following:

How can a work made for hire agreement affect who owns and controls a creative work?
What ownership or control issues might arise when two or more people jointly create a work?
Do you think the current duration of copyright protection, generally the life of the author plus 70 years, creates a fair balance between protecting creators and allowing the public to eventually use and build upon creative works? Why or why not?
Why are clear, written licensing agreements important when someone gives another person or organization permission to use a copyrighted work?
What problems could arise when creators, collaborators, or organizations rely only on verbal agreements or assumptions about ownership and permitted use?
