M4. Discussion: Fair Use or Infringement? Where Do You Draw the Line?

Fair use is one of the most misunderstood areas of copyright law. Although it may allow limited use of copyrighted material without permission, determining whether a use is fair requires consideration of four factors: the purpose and character of the use, the nature of the copyrighted work, the amount and substantiality used, and the effect of the use on the potential market for the original work.

Consider a situation in which someone wants to use copyrighted material for education, commentary, criticism, social media, a creative project, or another purpose. In your response, address the following:

What is a real-world or hypothetical example in which fair use might apply?
How would the purpose and character of the use affect whether the use could be considered fair?
How would the nature of the copyrighted work and the amount of the work used influence your analysis?
Could the use affect the market or value of the original work? Why or why not?
Based on the four factors, do you think the use would qualify as fair use or copyright infringement?
If fair use does not apply, could the public domain, a Creative Commons license, freedom of panorama, or another form of permission make the use lawful?
